This website is operated by Zoe Antona. Throughout the site, the terms “we,” “us,” and “our” refer to Zoe Antona.
By visiting this website, purchasing artwork, commissioning work, submitting payment for custom fabrication, or otherwise using the services offered through this website, you agree to these Terms of Service.
Please review these Terms before making a purchase. By completing a transaction through this website, you agree to the terms applicable to that purchase.
1. ARTWORK AND SERVICES
Zoe Antona offers original artwork, commissioned work, custom fabrication, and related creative services.
Because many items are handmade or individually fabricated, slight variations in color, texture, dimensions, surface, finish, or other characteristics may occur. These variations are inherent to handmade and custom work and are not necessarily considered defects.
We make reasonable efforts to represent artwork accurately through photographs, renderings, descriptions, measurements, samples, and other materials. However, colors and appearance may vary depending on lighting, photography, and display settings.
2. CUSTOM FABRICATION AND COMMISSIONS
Custom fabrication and commissioned work may be based on an independently approved proposal, estimate, scope of work, design, rendering, correspondence, or other project documentation.
Payment through this website does not replace the terms of an applicable written project agreement or approved scope of work. If a separate written agreement exists for a project, that agreement will control in the event of a conflict with these Terms regarding the specific project.
Project pricing is based on the approved scope at the time the price is provided. Changes requested after approval may result in additional costs and/or changes to the project timeline.
Because custom work is fabricated by hand, reasonable variations from drawings, renderings, reference images, samples, or prototypes may occur.
3. DEPOSITS AND PROJECT PAYMENTS
Certain custom fabrication, commissioned artwork, and other projects may require a deposit before work begins.
The amount and payment schedule will be communicated before purchase and may also appear on the applicable payment or product page.
Unless otherwise stated in writing, deposits are applied toward the total project price.
Once materials have been ordered, fabrication has begun, or other project-specific costs have been incurred, deposits may become non-refundable to the extent permitted by applicable law.
When a project requires a final payment, the remaining balance must be paid according to the agreed payment schedule. Where applicable, final payment may be required after approval of completed work and before shipment, delivery, installation, or release of the work.
Payment of a deposit constitutes authorization for Zoe Antona to begin performing the work associated with the approved project scope.
4. PROJECT CHANGES
Changes requested after a project has been approved may be considered a change in scope.
Additional design work, fabrication, materials, labor, shipping, installation, or other expenses resulting from a requested change may be charged separately.
Any significant additional charges will be communicated before the additional work is performed whenever reasonably practicable.
Changes to the approved scope may also affect estimated completion or delivery dates.
5. PRICING AND PAYMENT
All prices are listed in U.S. dollars unless otherwise stated.
Prices may change without notice before a purchase or project agreement is completed. Once a specific project price has been agreed upon, changes will only be made as permitted by the applicable agreement, approved change in scope, or these Terms.
Customers are responsible for providing accurate billing, shipping, delivery, and contact information.
We reserve the right to refuse, cancel, or refund an order in the event of an obvious pricing error, unauthorized transaction, suspected fraud, or other circumstances reasonably requiring cancellation.
Payments made through this website are processed using third-party payment services provided through Shopify and its supported payment providers.
6. SALES TAX
Applicable sales tax may be collected when required by law. The amount of tax charged may depend on the nature of the transaction and the customer's shipping, delivery, or billing location.
Customers are responsible for any taxes, duties, or similar charges for which they are legally responsible and which are not collected at checkout.
7. SHIPPING, DELIVERY AND INSTALLATION
Shipping, delivery, and installation arrangements vary depending on the artwork or project.
Any estimated completion, shipment, delivery, or installation date is an estimate unless expressly guaranteed in writing.
Delays may occur because of fabrication requirements, material availability, carrier delays, weather, approvals, site conditions, or circumstances outside our reasonable control.
Customers are responsible for providing accurate delivery information and, when applicable, ensuring that the installation or delivery location is accessible and ready for the work.
Additional terms concerning shipment or delivery may be provided in our Shipping Policy or in the applicable project agreement.
8. RETURNS, CANCELLATIONS AND REFUNDS
Original artwork, custom fabrication, and commissioned work may be subject to different cancellation and return conditions.
Because commissioned and custom-fabricated work is created specifically for an individual customer or project, it may not be eligible for return or refund once fabrication has begun, except where required by law or otherwise agreed in writing.
Eligibility for returns, cancellations, exchanges, or refunds is governed by our Refund Policy and any separate written agreement applicable to the project.
9. DAMAGE DURING SHIPPING
If artwork or fabricated work arrives damaged, the customer should contact Zoe Antona as soon as reasonably possible through the Contact page on this website and retain the original packaging and documentation of the damage.
Photographs of the item, packaging, shipping label, and damage may be required so that a carrier claim or other resolution can be pursued.
10. INTELLECTUAL PROPERTY
Unless expressly agreed otherwise in writing, the sale of an original artwork, commissioned work, or fabricated piece does not transfer the copyright or other intellectual-property rights associated with the work.
Zoe Antona retains all applicable copyrights and intellectual-property rights in original artwork, designs, photographs, drawings, renderings, concepts, and other creative materials created by Zoe Antona.
Purchasers may not reproduce, manufacture, commercially distribute, license, or create derivative commercial products based on the work without prior written permission.
11. PHOTOGRAPHY AND PORTFOLIO USE
Unless otherwise restricted by a separate written agreement, Zoe Antona may photograph completed work and use images of the work for portfolio, website, social media, exhibition, publication, promotional, archival, and other professional purposes.
Confidential business information or other information specifically agreed to be confidential will not intentionally be disclosed through such use.
12. WEBSITE USE
You may not use this website or its content for any unlawful purpose, attempt to interfere with the operation or security of the website, introduce malicious software, scrape or improperly collect information, or infringe upon the intellectual-property rights of Zoe Antona or others.
Website content may not be reproduced, sold, distributed, or commercially exploited without permission except as permitted by law.
13. THIRD-PARTY SERVICES
This website may use or link to third-party services, including Shopify and payment, shipping, social-media, or other service providers.
We are not responsible for the independent operation, availability, content, privacy practices, or policies of third-party websites or services.
Use of third-party services may also be subject to the terms and policies of those providers.
14. DISCLAIMER AND LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Zoe Antona will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of this website or the purchase or use of products or services offered through it.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Nothing in these Terms is intended to eliminate rights or remedies provided to consumers under applicable law.
15. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Zoe Antona from third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful use of this website, your violation of these Terms, or your infringement of another person's rights.
16. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary. The remaining provisions will continue in effect.
17. GOVERNING LAW
These Terms of Service and transactions made through this website are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise.

We may update these Terms of Service periodically. The most current version will be posted on this page with an updated revision date.
Your continued use of the website after changes are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.
